Section 1: Definitions
1.1 “Particle Platform” means the Third Party Product known as the Particle prototype-to-production platform for developing Internet of Things products.
1.2 “Porter Platform” means the Bright/Contrast suite of development, prototyping and testing Products and Services for use with the Particle Platform and other Third Party Products to automatically build user interfaces and control devices, among other things.
1.3 “Products” means the application and other software provided by Bright/Contrast under the Porter brand that is available for download either directly from Bright/Contrast or via a third-party app store.
1.4 “Service Companies” means third-party service companies providing certain services to Bright/Contrast (e.g., credit card billing) for which it is necessary to provide users’ personally identifiable information.
1.5 “Services” means any and all services and hosted software applications provided by Bright/Contrast under the Porter brand, including but not limited to those provided in connection with the Website and any other software services offered as part of Bright/Contracts’ Porter brand offerings.
1.6 “Third Party Product” includes but is not limited to any application, website, API, software, or hardware that interacts with, uses or connects to any Products or Services but which is not provided by Bright/Contrast.
1.7 “You” means yourself and any entities you represent or act on behalf of.
1.8 “Website(s)” means any web domains owned, operated, branded or co-branded by Bright/Contrast under the Porter name, including, without limitation, porterapp.com.
Section 2: How Bright/Contrast Collects Data
2.1 When You Visit Our Websites or Use The Porter Platform. Bright/Contrast collects certain data from visitors to the Websites in order to continuously improve and enhance our customer’s experiences. This data is collected via the following methods:
2.1.1 The Websites, like many other websites, will store session information (often called “Cookies”) in your browser that will help the Porter Solution identify information such as browsing activity, IP addresses and page view order. You do have the option to not allow the use of these Cookies; the majority of browsers will have a “help” tool that will help you to prevent Cookies if you want to, but Bright/Contrast recommends you keep Cookies active as it will provide a better user experience on our Websites.
2.1.2 When You visit the Websites, the web servers automatically log typical website analytic data from visitors to our site. This data, which may include details such as browser type, IP addresses, site visit length and referral URL, is used for systems administration, detecting use patterns and generally improving customer experience.
2.1.3 Bright/Contrast sees and logs non-personally identifiable data when You use The Porter Solution. Bright/Contrast logs this anonymous data in our system and stores it on Third-Party servers. The only personally identifiable information that is collected in that process will be the account details You supplied when creating Your account or when contacting Bright/Contrast using the Websites.
2.2 Information You provide
2.2.1 When You create an account with Bright/Contrast, You provide us with data that may include your name, location, an email address and password. Bright/Contrast may also give you the option to voluntarily share other data with us that is connected to your account. If any of these details change, You may update your account at any time and modify, correct or delete your account details.
2.2.2 If you are connecting the Porter Solution to a Third Party Product, such as the Particle Platform, You may be required to provide your account information for that Third Party Product to obtain access to the Third Party Product. Your Third Party Product account information is not stored or accessible by Bright/Contrast. Instead, a small piece of software called an “access token” will be received and retained by the Product or Service you are using, after which that Product or Service will be able to access the Third Party Product on your behalf using this token.
2.2.3 When You actively provide information via any Websites, for example when You submit a support request or sign up to receive communications regarding the Porter Platform, Bright/Contrast may retain that data for You for later use. This data is stored on secure third party servers.
2.2.5 You may actively provide payment details when purchasing Products or Services. Bright/Contrast uses a third-party secure e-commerce site with a Level 1 PCI compliant payment system, for direct online sales. No employees of Bright/Contrast have access to the credit card details associated with these purchases.
2.3 Information provided by third parties
2.3.1 When connecting a Product or Service to a Third Party Product, Bright/Contrast will use the information provided by that Third Party Product to provide certain functionality of the Product or Service with or in connection with that Third Party Product.
Section 3: How is Data Used by Bright/Contrast?
3.2 Email addresses and any other contact information supplied by You may also be used by Bright/Contrast to respond to emails, phone calls and requests.
3.3 Bright/Contrast may collect and create anonymous data by excluding personally identifiable information. Bright/Contrast reserves the right to use anonymous data for any purpose and share anonymous data to third parties at its sole discretion.
Section 4: How Is Data Kept Secure?
4.1 Bright/Contrast uses Secure Socket Layer (SSL) encryption on the Porter Solution, including the Websites. Bright/Contrast users SSL encryption when communicating with Third Party Products.
4.2 Data collected by Bright/Contrast via the Porter Platform, including the Websites, is stored on secure third-party servers.
Section 5: When is Data Shared?
5.1 Bright/Contrast may have a third-party process or analyze, on behalf of Bright/Contrast, some of the data we have collected.
5.2 When appropriate, Bright/Contrast may share personal data with partner entities and persons who are actively doing business with Bright/Contrast and have entered into a contract with Bright/Contrast which will include protecting the data shared.
5.4 Bright/Contrast will share personal information with companies, organizations or individuals outside of Bright/Contrast if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:
5.4.1 Meet any applicable law, regulation, legal process or enforceable governmental request.
5.4.2 Enforce applicable Terms of Service, including investigation of potential violations.
5.4.3 Detect, prevent, or otherwise address fraud, security or technical issues.
5.4.4 Protect against harm to the rights, property or safety of Bright/Contrast, our users or the public as required or permitted by law.
Section 6: Additional Information
6.2 Bright/Contrast will not intentionally gather information from children under the age of 13.
6.3 The Porter Platform, including the Websites, are not directed at children under the age of 13. If You are younger than 13, please do not provide any information in connection with your use of our Products or Services.
6.4 Bright/Contrast reserves the right to transfer any and all information that it collects in the event that another company acquires Bright/Contrast or our assets via a merger, acquisition or sale.
